What is Consent Management (Telecom India)?

Consent management, in the Indian telecom context, is the process of capturing, recording, and honoring a customer’s permission before sending them commercial communication or recording their calls. It sits at the center of TRAI’s commercial communication rules and the DPDP Act, 2023, and is what determines whether a business’s outreach is legally compliant or exposes it to penalties and blocking.

What consent needs to cover

  • Communication preferences: whether a customer has opted in to promotional calls or messages, and through which channel.
  • Call recording: explicit, informed consent before a call is recorded, under the DPDP Act’s requirements.
  • Purpose limitation: consent tied to a specific stated purpose; data or contact permission gathered for one purpose generally can’t be reused for a different, unrelated purpose without fresh consent.
  • Revocation: a clear, accessible way for a customer to withdraw consent at any time, and a business’s obligation to honor that promptly.

Why this has become harder to get away with ignoring

Consent used to be treated by many businesses as a formality buried in fine print. That’s shifted meaningfully with the DPDP Act’s explicit requirements around free, specific, informed, and unambiguous consent, and with telecom operators’ increasingly aggressive network-level filtering of unregistered or non-compliant traffic. A business now faces both a regulatory risk and a practical delivery risk: non-compliant traffic increasingly just doesn’t reach the customer at all.
